Overview:
Provide labor and employment (L&E) legal support to all business in the region of Mainland China, protecting the company's interests by identifying and mitigating legal risks in accordance with the applicable legal requirements and company policy. Capable of working independently, subject to the minimum guidance from Sr. Employment Counsel.
Key Responsibilities
? Contract and policy review: Draft and review various templates in respect of the establishment, execution, and termination of employment, as well as post-employment covenants, as well as third party employee (e.g. labor dispatch, outsourcing, shared workforce, etc.) matters; review various HR policies of China sites in accordance with the applicable laws and regulations, as well as company compliance requirements, policies and guidelines.
? Other L&E daily consultation: Take care of the daily consultation from HRs nation-wide in respect of China employment matters.
? Labor disputes resolution: handle labor dispute arbitration and litigations, along with outside counsel (and other in-house attorneys where appropriate). Collect and review facts and information; provide preliminary opinion on the exposure and downside risk assessment; recommend a path to resolve the disputes; and oversee necessary execution to ensure that disputes are resolved in a manner that best represents the company's interests.
? Internal projects: Collaborate with HRs, and other members of the global and regional Law Department on matters and projects (e.g. M&A, business divestiture, plant relocation, etc.) that require a team effort.
? Training: Prepare training materials in respect of various L&E topics and provide L&E training to China HRs in a practical way.
Requirements and Qualifications
? Can draft standard legal documents with minimal review
? Can deliver clear legal advice effectively
? Good communication skills in Chinese and English – not only know what you are doing, but also be able to help others understand your points for business decision-making.
? At least 3 years’ dedicated L&E legal support PQE gained in a reputable Chinese / international law firm and/or in-house law department of a multinational corporation. Leading Chinese / international law firm experience will be a plus.
? Experienced in provide L&E trainings.
? Graduate from an accredited law program or a law degree in China. Overseas legal education background will be a plus.
? Pass the Bar Exam in China.
